1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and BehaviorConnect regarding your access to and use of the BehaviorConnect platform. By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Eligibility and Registration

2.1 Age Requirement

You must be at least 18 years of age to use BehaviorConnect. By registering, you represent and warrant that you meet this age requirement.

2.2 Account Registration

  • You must provide accurate, current, and complete information during registration
  • You must maintain and promptly update your account information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account

2.3 Professional Credentials

If you represent yourself as a behavioral therapist or mental health professional, you must possess the appropriate credentials, licenses, or certifications. Misrepresentation of professional qualifications is grounds for immediate account termination and may result in legal action.

3. Acceptable Use Policy

3.1 Permitted Uses

BehaviorConnect may be used for:

  • Professional networking with other behavioral health professionals
  • Sharing educational resources and best practices
  • Participating in professional discussions and groups
  • Collaborating on non-clinical professional development
  • Accessing and contributing to the resource library

3.2 Prohibited Activities

You agree NOT to:

  • Share protected health information (PHI) or confidential patient/client data
  • Provide clinical advice or therapeutic services through the platform
  • Post content that is defamatory, obscene, threatening, or harassing
  • Violate any applicable professional codes of ethics
  • Infringe upon intellectual property rights of others
  • Distribute spam, advertisements, or unsolicited commercial content
  • Impersonate any person or entity
  • Upload malware, viruses, or other malicious code
  • Attempt to gain unauthorized access to the platform or other users' accounts
  • Use automated systems (bots, scrapers) without authorization
  • Engage in any illegal activities

4. User Content

4.1 Content Ownership

You retain all ownership rights to content you post on BehaviorConnect ("User Content"). However, by posting content, you grant BehaviorConnect a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, display, and perform your User Content in connection with operating and improving the platform.

4.2 Content Responsibility

You are solely responsible for:

  • The accuracy and legality of your User Content
  • Ensuring you have the right to share the content you post
  • Any consequences arising from posting your User Content
  • Maintaining backups of your important content

4.3 Content Moderation

BehaviorConnect reserves the right, but not the obligation, to monitor, review, edit, or remove any User Content at our sole discretion. Content may be subject to approval before being made visible to other users. We may remove content that violates these Terms or is otherwise objectionable.

5. Intellectual Property Rights

5.1 Platform Ownership

BehaviorConnect and its original content, features, and functionality are owned by BehaviorConnect and are protected by international copyright, trademark, and other intellectual property laws.

5.2 Copyright Infringement

We respect intellectual property rights. If you believe content on our platform infringes your copyright, please contact us with detailed information about the alleged infringement.

6. Groups and Organizations

6.1 Group Creation and Management

Users may create groups for professional collaboration. Group creators and administrators are responsible for managing their groups in accordance with these Terms and ensuring member compliance.

6.2 Organization Accounts

Organizations must be legitimate professional entities. Organization owners and managers have enhanced responsibilities for content moderation and member conduct within their organizations.

7. Privacy and Data Protection

Your use of BehaviorConnect is also governed by our Privacy Policy. By using the platform, you consent to the collection and use of information as described in our Privacy Policy.

IMPORTANT: BehaviorConnect is NOT HIPAA-compliant and must NOT be used to store, transmit, or process protected health information (PHI).

8. Disclaimers

8.1 No Professional Services

BehaviorConnect is a networking platform, not a healthcare provider. The platform does not provide medical, therapeutic, or professional advice. Any information shared on the platform is for educational and networking purposes only and should not be considered professional consultation.

8.2 No Warranty

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the platform will be uninterrupted, error-free, or secure.

8.3 Third-Party Content

We are not responsible for the accuracy, completeness, or reliability of User Content or content from third parties. Users rely on such content at their own risk.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BEHAVIORCONNECT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the platform
  • Any conduct or content of any third party on the platform
  • Any content obtained from the platform
  • Unauthorized access, use, or alteration of your transmissions or content

10. Indemnification

You agree to indemnify, defend, and hold harmless BehaviorConnect and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including attorney fees) arising from:

  • Your use of the platform
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your User Content

11. Termination

11.1 Termination by BehaviorConnect

We may terminate or suspend your account immediately, without prior notice, for:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Misrepresentation of professional credentials
  • Sharing protected health information
  • Any reason we deem necessary to protect the platform or other users

11.2 Termination by You

You may terminate your account at any time through your account settings or by contacting us. Upon termination, your right to use the platform will immediately cease.

11.3 Effect of Termination

Upon termination, your account data may be deleted. We are not obligated to retain your content after termination. Certain provisions of these Terms will survive termination.

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to conflict of law provisions.

12.2 Arbitration

Any disputes arising from these Terms or your use of the platform shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14.3 Waiver

No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

14.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
